The Supreme People's Court (SPC) is the highest judicial organ in China. It is directly under the National People's Congress (NPC) Standing Committee, and operates independently of the State Council and its departments. The SPC president is elected by the NPC. The SPC's primary responsibilities include trying cases of great influence and hearing appeals from lower courts, supervising the work of lower courts as well as special courts at every level, and producing judicial explanations of laws that must be implemented nationwide. For example, the SPC recently published a judicial explanation of the amended Patent Law in order to guide its implementation and resolve ambiguities. In addition to the judicial committee, the SPC's tribunals include the No. 1 Criminal Tribunal, the No. 2 Criminal Tribunal, the Civil Tribunal, the Economic Tribunal, the Administrative Tribunal, the Complaint and Appeal Tribunal, and the Communication and Transportation Tribunal. SPC verdicts are made public on its website.

The Supreme People's Procuratorate (SPP) reports directly to the NPC Standing Committee and is responsible for nationwide legal supervision. It oversees the work of regional and special people's procuratorates at all levels, which are the main organs for ensuring unified application and proper enforcement of laws. The SPP is responsible for hearing cases related to corruption or other misconduct, ensuring proper judicial process in investigation and prosecution of criminal cases, submitting protests of wrongful judgments to the Supreme People's Court, overseeing the operations of prisons and reeducation through labor centers, and drafting regulations and explanations of regulations related to legal supervision.
